Abstract:This bachelor thesis examines the way in which solidarity is conceptualised in the EU’s 2024 Asylum and Migration Management Regulation (AMMR). Solidarity is one of the fundamental values of the European Union, however, its implementation in the field of the common asylum policy is repeatedly criticised. The reason for this is that under the current Dublin system, frontline member states are responsible for a disproportionately high number of asylum seekers. The AMMR aims to redress this imbalance by introducing a “new solidarity mechanism”. It is highly relevant to examine whether this mechanism actually leads to effective changes in the Dublin system. By conducting a directed qualitative content analysis of the text of the AMMR and related EU legislation, this study contributes to closing this knowledge gap. The analysis shows that the solidarity mechanism of the AMMR introduces a number of new procedures and bodies, leading to a greater binding effect and regularity of solidarity measures. However, the mechanism is also very flexible and only comes into play in situations where a member state is already overburdened. The main features of the Dublin system therefore remain in place and it is not justified to speak of a complete re-conceptualisation of solidarity.
