Abstract: | Sexual offenses remain a significant global issue, with movements like #MeToo and the Dutch BOOS documentary increasing societal awareness and police reports in the Netherlands. While traditional responses focus on punishment, restorative justice approaches, such as victim-offender mediation (VOM), offer structured dialogue for healing and accountability. This study investigates predictors of willingness to participate in VOM among victims and offenders of sexual violence, using data from Perspectief Herstelbemiddeling (PHB). Results show that having a pre-existing relationship positively influenced victim willingness but negatively affected offender willingness, contradicting expectations. Age did not significantly predict victim willingness, and older victim involvement reduced offender participation. Contrary to hypotheses, offenders in VOM did not show a stronger tendency toward reintegrative shame over stigmatizing shame. Exploratory analyses indicated that agency needs were more common in victims, while communion needs were more prevalent in offenders. The study highlights the need for tailored mediation processes, addressing emotional barriers, and enhancing data collection for better restorative justice outcomes. These findings contribute to understanding VOM dynamics and offer practical recommendations for improving restorative justice practices in sexual violence cases. |
