Abstract:This report provides a public administration perspective on the classically legal topic of the European Arrest Warrant (EAW). By focusing the analysis on the performance of the Amsterdam district court, more light is shed on the dynamics of inter-organizational cooperation of Dutch judicial authorities with nine other Member States, changes in surrender patterns in the period 2006-2014, recurring legal issues and the influence of coordination by Eurojust and the EJN. The research questions are answered through a multi-method case study approach, which include quantitative and qualitative analyses of a sample of 116 Amsterdam district court cases, legal analyses and an interview with Eurojust employees. Although some specific issues do persist, it is concluded that in most cases the Amsterdam district court performs well with regard to its balance between automatic surrender and appropriate judicial protection. However, due to capacity problems it seems that the Amsterdam district court performs less well with regard to its turnover speed, which is problematic in light of EAW time limits. Furthermore, while differences between similar and dissimilar Member States were found with regard turnover times, the amount of additional questions and postponements, there is no evidence that the surrender vs. refusal ratio also differs.
