Abstract: | The Geneva Convention, a legally international binding instrument for refugee law, was signed in the year 1951 to define the standards for the treatment of refugees. The Convention is used as a tool to apply legislation on when and who can be qualified as a “refugee”, and it has been used as an international instrument to give protection to people in need. Even though the Geneva Convention has been implemented in International and National asylum legislations there still exist irregularities between the different legal levels. To clarify whether a third country national has to be originated from a country which is currently in war or not, this paper will examine the following question: Under which conditions can third country nationals coming from post conflict countries obtain and maintain their refugee status in Europe? An third country national can apply for asylum in the European Union on grounds of three legislations; The Geneva Convention, The Qualification Directive, and the national legislation. Case law from post conflict countries, Iraq and Afghanistan in this research, will provide information of how the legislations are applied. |
