Abstract:Automated decision-making systems and decision support systems are increasingly used within the public sector, and in this thesis the question is asked whether these can be used by an individual civil servant without undermining the epistemic condition of moral responsibilty. By looking at the different rule-based and machine learning applications currently available, as well as the explanations and outcomes offered by these systems, the different conditions of moral responsibilty are assessed, with particular attention being paid to the epistemic condition, and the different conceptualisations of this condition. Furthermore, several legal conceptualisations of (moral) rights are introduced to determine whether it would be possible to satisfy the epistemic condition with current explanatory mechanisms.
