Abstract: | This study investigates the challenges online platforms face under the Digital Services Act (DSA). This new regulatory framework aims to enhance digital safety, protect user rights, and ensure fair business practices. Focusing on legal and operational hurdles, this study leverages expert opinions to provide a comprehensive analysis of compliance challenges. Given the recent introduction of the DSA and the scarcity of literature, this research draws parallels with the General Data Protection Regulation (GDPR) through analyses of both regulations' requirements and two systematic literature reviews. The empirical component includes interviews with experts in digital law, IT audit, and platform representatives, enriching the understanding of operational difficulties and compliance barriers. Findings indicate that compliance is complicated by factors such as vague legal terms, lack of guidance, the decentralized structure of platforms, and fast-paced development cycles. To address these challenges, it is essential to establish centralized leadership and promote cross-functional collaboration. The study concludes in a risk mitigation framework offering actionable insights for navigating DSA compliance. Recommendations emphasize the need for strong internal compliance frameworks, enhanced cooperation with regulatory bodies, and investments in both personnel and internal systems, such as advanced content moderation technologies. This thesis contributes to the academic and practical discourse on digital regulation, providing stakeholders with strategies to address the complexities of the DSA. |
