Abstract:With effect from 1 January 2022, the Construction Quality Assurance Act (WKB) will enter into force. This Act provides for system supervision in which the technical building regulations from the Building Act will be guaranteed by private independent quality assurers (KB) as part of the implementation of step-by-step supervision by instrument providers (IA) and an admissions organization (TO). An important change is also that it must be demonstrated that there is justified confidence in what has been built and that it complies with the applicable rules: a change from making it plausible that a building complies under the current system to making it plausible that a building complies under the new supervision system. So not only is there a role shift, but it is also necessary to estimate in advance where the risks are in order to determine at the time of delivery that the regulations are being complied with. Within this framework, the legislator prescribes the application of a risk assessment (RB WKB) at project level, as part of an assurance plan (BP). This risk assessment must provide the necessary transparency, insight and confidence that the risky parts are under control and are monitored during the construction process. Each IA is free to implement the RB WKB as it sees fit, provided it is approached integrally. This results in different outcomes.
